Elza White. TERMS & CONDITIONS OF SALE
Unless specifically agreed to in writing prior to commencement of the contract the following items are not included in our contract price:
Delivery Costs - from our workshop and insurance of goods during transit. Delivery costs will be included in our quotation, if requested. If not, they will be invoiced separately at the end of the contract.
Guarantee – Elza White undertakes to produce goods made from the best available materials and good workmanship and wherever practicable repair or replace free of charge any goods proved to be defective in these respects if so advised of them within the six months from the date of delivery. For faulty goods please contact us in writing via email. No liability can be accepted for defects caused by Client using the goods outside the limits of the specification for which they were sold. - Under no circumstances does Elza White undertake liability for consequential loss or damage of any description. This does not affect your legal rights under the Consumer Rights Act 2015.
Limitation of responsibility - We do not accept responsibility for (1) any losses that were not foreseeable when this contract was formed, (2) any loses that were not caused by a breach on our part, and (3) relate to losses to non-consumers.
Customers Rights - This is just a summary of the key rights under The Consumer Rights Act 2015 and is not intended to replace the contract. Customers should be advised that detailed information from Citizens Advise can be found at www.citizensadvice.org.uk a. Up to thirty days: if your goods are faulty, you can get a refund; b. Up to six months: if they cannot be repaired or replaced, then you are entitled to a refund in most cases.
TERMS of PAYMENT
- 50% of the Contract Price to be paid when the order is placed in writing.
- The balance of 50% is to be paid prior to the goods being collected or dispatched.
PLEASE NOTE: No work can commence until the deposit has been received. Once the deposit has been received, we will work together until we are able to agree a design to your specification.
• All prices quoted are inclusive of V.A.T. Prices remain fixed for a period of three months but are subject to revision in the event of specification changes, on a change in material costs, etc.
• No premium time working is allowed for unless specifically requested by client.
• Manufacture will not commence until the deposit has been received and goods remain the property of Elza White until payment has been received in full.
• Design and specification of the goods remain the property of Elza White and must not be reproduced in any form without the written permission and/or purchase from Elza White
• Title of the goods does not transfer to the customer until full and final payment is received.
• Prices are in POUNDS STERLING. • Payments accepted are cash, BACS transfer, Credit and Debit cards and Paypal.
DESIGN RIGHTS. All designs created by Elza White are the intellectual property of Elza White and must not be reproduced in full or part without purchasing the design first. Whilst we endeavour to keep all bespoke commissions unique, some elements of a design may be repeated in future work this is at the discretion of Elza White. DELIVERY PERIOD. Delivery periods stated at the time of quotation are given in good faith and are based upon our current workload and procurement of bought out materials. However, please be aware that the volume of work passing through our workshop varies from month to month and actual delivery dates can be ascertained at point of order. If a situation arises which is (1) outside of our control and (2) affects the estimated date of delivery we will let you have a revised date for the delivery of goods. Delivery of the goods will happen when we deliver them to the address provided by you.
TEMPORARY LOANS OF GOODS. We may, at the sole discretion of Elza White agree to loan goods for a temporary period to you, the Borrower. The Borrower agrees to pay the replacement cost of the goods in the event of those goods being lost, stolen or damaged. The loan period and replacement cost must be agreed in advance and in the event that the goods are not returned at the end of the agreed period, for whatever reason, the Borrower agrees to pay the replacement cost of the goods. The goods must be returned to Elza White in the original packing or equivalent and must either be returned by hand or if not,by courier, which must include adequate insurance of the replacement cost. If the goods borrowed are for use in circumstances that may attract public attention in any way, written credit must be given to Elza White as designer and maker of the goods, evidence of which must be provided to Elza White prior to the commencement of the loan period. The right to levy a charge for the temporary loan is within the sole discretion of Elza White and if such charge is to be made, it must be paid by the Borrower prior to the commencement of the loan period.
DISPUTES. If you are unhappy with your product or service please contact us at your earliest convenience. We strive to resolve all disputes amicably, quickly, and efficiently. If we are unable to resolve the dispute, the courts of England and Wales have exclusive jurisdiction to deal with the dispute.
